Turaworld Terms of Use

1. General information

Turaworld (also referred as “We” or “Us”) is a meeting point for advertisers, which can be business owners, touristic and travel experiences and service organisers, on the one hand, and visitors on the other, i.e. those persons interested in the services of the advertisers.

In these Terms, the concept of “Visitor” refers to registered users who are looking for touristic and travel experiences, while “Advertisers” refers to entities or individuals who publish advertisements for touristic and travel activities and experiences. For the purposes of these Terms, both Visitors and Advertisers will be referred to collectively as “Registered Users” (or “You”).

The use of the Website (the “Website”) implies the express and full acceptance by the User of the provisions of these Terms, which expressly include by reference to us the Privacy Policy and the Cookie Policy. Users undertake to use the Website in accordance with the provisions of these Terms and the law.

As a User, you must be 18 year-aged or older to use the Website, and if you register on behalf of a third party (for example, for Advertisers), you warrant you can represent that entity to register it on the Website and publish and process any content or that you have been authorized to do so by the representative or agent.

Modifications. Turaworld reserves the right to modify, without prior notice, the design, presentation and/or configuration of this Website, as well as some or all the services, and their corresponding updating, as well as these Terms. Any modification will be effective from the date of publication, and each use of the Website after such publication will be subject to the new Terms, so please read them carefully. We will notify you of any changes to these Terms, and your subsequent use of the Website constitutes your acceptance of them. We may contact you through the Website (for example, by asking you to accept the changes before you continue to use the Website) or by email.

 

2. Purpose and services scope

These Terms regulate User’s access to and use of the Website’s services (“Service(s)”).

The purposes of Turaworld are those of:

  • To allow Advertisers to create and publish their business profile through which they will publish touristic events and advertise their business.
  • To allow Visitors to access the profiles and information published by the Advertisers.

These Website’s purposes and characteristics may be modified, without prejudice to the provisions of applicable law, such as privacy. You accept that it is essential that our Website can be modified over time and this is an important basis on which we grant you access to the Service. Once we have made changes to the Service, your continued use of the Service will indicate that you have accepted any changes to the Service. You can always stop using the Service or deactivate your account through the Website settings. We will try, where possible and reasonable, to contact you about any significant changes to the Service.

In no manner whatsoever is Turaworld an agent or otherwise responsible for the provision of the Advertisers’ services, nor any payment or other responsibilities of Visitors if purchasing (off-site) any services advertised here.

 

3. Sign up and User Profile

    • User Profile

In general, to enjoy Turaworld’s services, Advertisers and Visitors are required to sign into the Website.

In order to complete registration, each User must indicate a username, an e-mail address and create a password. The User will then receive an e-mail at the indicated e-mail address, in order to validate the registration process and verify the e-mail address.

If the e-mail address is not verified within 48 hours, it will be suspended until this action is carried out.

The data provided during registration, and in general any other information entered on the Website, must be true, updated, accurate and complete. The registration data will be process in accordance with the provisions of our Privacy Policy. These data will be validated by Turaworld support staff or automated systems.

As a registered user, you are responsible for the custody of your credentials, which are personal and non-transferable, and consequently assume any damages that may arise from their improper use, as well as the transfer, disclosure or loss of them. For this purpose, access to restricted areas and/or the use of the contents of the Website made under the credentials will be deemed to have been made by you, and you will be responsible in all cases for such access and use. In the event of any circumstance implies a risk of access and/or use by unauthorised third parties, you must immediately notify Turaworld so that it can immediately proceed with the blocking and facilitate, if necessary, the replacement of the same.

  • Creation of an Advertiser Profile

Once you have registered, as an Advertiser you can create the profile of your business. To do this, you must click on the “Add listing” button and enter all the fields that refer to general information about your business in question, such as the name of the business, category of the business, description and you will be able to provide the address, city, website, opening hours, languages spoken by the staff, price ranges, links, images and videos related to the business. As an advertiser, you can always access your own profile and modify it whenever and however you want.

 

4. End of our relationship

If at any time you have reason to disagree with these Terms or any changes made to the Service, you shall immediately stop using the Service.

If you wish to terminate your use of the Service, you may deactivate your account by sending an email to info@turaworld.com stating you wish to close your account or an account you administer. Once your account is deactivated, you will not be able to access your account, or any data previously stored in your account. For information on the conservation of this data, please check our Privacy Policy.

We may immediately terminate your access to the Service if you do not comply with these Terms, including in particular the Acceptable Use Rules set out below, the law or morality.

The Acceptable Use Rules define the use you shall make of the Website with regard to the content of the messages or information provided which is solely and exclusively up to you. Turaworld is not responsible for the content of the messages you may disseminate and will not tolerate the publication of inappropriate content. If you believe that any content does not respect the Acceptable Use Rules or it violates current legislation, you can contact us through info@turaworld.com  and we will examine the content or conversation reported to take additional measures, such as sending a warning to the user or suspending their account if the content violates our Terms.

If You or We terminate your use of the Service, we may delete your User Content, account or any other information we have about you. You will also lose any rights you have to use the Service or access our content or your User Content. To the extent permitted by applicable law, we will not provide compensation for any loss you may suffer as a result of this termination.

Termination of your use of the Service and cancellation of your Account will not affect any of your outstanding obligations to us, nor any obligation of confidentiality with respect to personal data or other confidential information shared through the Website

 

5. Advertiser Content

Turaworld provides an independent platform for Advertisers to publish information about their businesses and/or activities. Advertisers confirm that any images, text or information that they make available or create while using the Service (“Advertiser Content”) will comply with these Terms and, in particular, with our Acceptable Use Rules below.

The Advertiser is the sole owner of and responsible for the Advertiser Content. As an Advertiser, you grant us a perpetual, irrevocable, worldwide, non-exclusive, royalty-free license to use, copy, reproduce and make available your Advertiser Content on our Website in order to allow Visitors to view and use your Advertiser Content. This authorized use of your Advertiser Content does not in any way affect your privacy rights and we will only use information that identifies you as set out in our Privacy Policy.

We do not verify or moderate any Advertiser Content before it is posted by the Advertiser on the Website. We may thereafter review, moderate, reject or remove any Advertiser Content if someone objects to it or if we believe that it violates any of these Terms.

 

6. Using Turaworld

Your non-exclusive right to use the Website and/or Services is personal and you are not authorised to sell or transfer your Account to another person. Your right to use the Website and/or Services does not prevent us from authorising others to do so as well.

Turaworld Acceptable Use Rules. While using the Website and our Services, you shall not:

a) Avoid, disable or otherwise interfere with the security related functions of the Service or the functions that prevent or restrict the use or copying of content accessible through the Service;

b) Create more than one account on the Service with the same role (however, you may connect all your social networks or other accounts to your account on the Service). This limitation does not apply to Users who create one account as an Advertiser and another as a Visitor;

c) Pretending to be someone else or misrepresent your identity or affiliation with another person or give the impression to be linked to Turaworld, if this is not the case;

d) Use the Service for any purposes other than those provided for in these Terms or if we have suspended or prohibited your use of the Service;

e) Send spam or repetitive messages, defend, promote or engage in any illegal conduct (including fraud or the sale of counterfeit or stolen goods) or conduct that causes injury or damage to any person or property;

f) Modify, interfere with, intercept, disrupt or hack the Service or collect any information from the Service that is not in accordance with these Terms;

g) Misuse the Service by deliberately introducing viruses, trojan horse, worms, logic bombs or other material that may damage the Service or any User of the equipment on the Service;

h) Send or provide any Advertiser Content that contains nudity, violence, or is abusive, threatening, obscene, misleading, false, inaccurate or offensive, as well as publish material in any format that involves the commission of illegal activities or for illegal purposes and, in general, any material that violates human dignity protection, minors, public order, consumer and privacy protection as well as intellectual and industrial property rights;

i) Sending or contributing any Advertiser Content with no permission from the content owner or otherwise infringing the copyright, trademark, confidentiality or other rights of third parties;

j) Use any Advertiser Content in breach of the license terms specified by the owner;

k) Submit or contribute any information or comments about another person without that person’s permission;

l) Threaten, abuse or invade another person’s privacy, or cause annoyance, inconvenience or unnecessary anxiety or the possibility of harassing, annoying, embarrassing, alarming or disturbing any other person in particular any Turaworld staff member;

m) Use any automated system, including but not limited to “robots”, “spiders” or “offline readers” to access the Service, for accessing or extracting any content or other data.

 

7. Warranties and limitation of liability

We use all commercially reasonable efforts to publish and provide the Website and its services and to correct any errors or unavailability. We do not guarantee the Website is error-free, and it may not always be up and running or available due to maintenance, connectivity errors or force majeure events. Except as otherwise provided in this document and to the extent permitted by applicable law, the Website and its services are provided “as is” and without any guarantee of satisfactory quality or suitability for purpose, and we make no commitment with respect to the performance or availability of the Website under these Terms.

Turaworld assumes liability to its registered Users for direct damages suffered by them due to our negligence or wilful misconduct. Except as otherwise provided in these Terms and to the extent permitted by applicable law, all indirect liabilities are excluded and neither the Registered Users nor Turaworld shall be liable to the other party for any loss of profits, data, interruption of business, loss of goodwill or damage to reputation, or any other indirect damages.

We are not responsible for any Registered User Content published on the Website, except as provided by applicable law. We do not actively review or moderate this content, but we do check this Content periodically to verify that it complies with our Acceptable Use Rules.

 

8. Applicable law and dispute resolution

As set out in our Legal Notice:

Applicable legislation and jurisdiction: Any dispute shall be submitted to the courts of the city of Barcelona, without prejudice to the rules of mandatory compliance and the extrajudicial procedures to which the parties voluntarily submit. If any provision of these conditions is deemed invalid by a competent court, the parties shall agree that the court shall attempt to give effect to the will of the parties in the manner reflected in the provision, all without prejudice to the full right and validity of the remaining provisions. Online Dispute Resolution (ODR): Notwithstanding the above, in accordance with Regulation (EU) 524/2013, the European Commission provides a free access platform for the extrajudicial consumer related online disputes resolution through electronic contracting (http://ec.europa.eu/consumers/odr/) to which the parties may voluntarily submit themselves, through the intervention of the so-called Dispute Resolution Body, which acts as a neutral intermediary between the two parties.
